Terms of use

These terms govern your subscription to Guaiaca through the Azure Marketplace and your use of the service.

Draft pending legal review. This page is not yet a binding document.

1. The service

Guaiaca is a FinOps service for Confluent Cloud provided by Datatchê. It reads the billing data of the Confluent Cloud organizations you connect and presents it to the users of your organization.

2. Subscription and billing

The service is sold as a SaaS offer on the Azure Marketplace and billed by Microsoft on your Azure subscription, per seat and per connected Confluent Cloud organization, according to the plan you choose. Cancellation is done from the Azure portal.

3. Your responsibilities

You provide a read-only Confluent Cloud credential that you control and may revoke at any time. You are responsible for who you invite into your tenant and for the roles you assign them.

4. What we commit to

We keep the service available and secure according to the support terms of your plan, never write to your Confluent Cloud account, and keep your data isolated and confidential.

5. Data ownership

Your data remains yours. Datatchê processes it only to provide the service, as described in the privacy policy.

6. Termination

Either party may end the subscription under the Marketplace rules. After the end of the subscription your data is deleted according to the retention described in the privacy policy.

7. Liability and governing law

Liability limits, warranties and the governing law are defined by the contract applicable to your purchase, as shown in the Azure Marketplace at the time of subscription.
